Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website located at funeral.sablemedia.io and sablemedia.io (the "Site") and the marketing services offered by Sable Media ("Sable Media," "we," "us," or "our"), headquartered in Salt Lake City, Utah and serving funeral home clients throughout the United States. By accessing the Site or engaging our services, you agree to these Terms. If you do not agree, please do not use the Site.

1.Our Services

Sable Media provides digital marketing services for funeral homes, which may include management of Google Ads campaigns, Google Local Services Ads, landing page creation, search engine optimization, review generation systems, call tracking, and related reporting and consulting (collectively, the "Services"). Our Services are available to funeral homes nationwide. The specific Services provided to any client, along with fees and terms, are defined in a separate written agreement or proposal between Sable Media and that client (a "Service Agreement"). In the event of a conflict between these Terms and a Service Agreement, the Service Agreement controls.

2.No Guarantee of Results

Marketing outcomes depend on many factors outside our control, including market conditions, competition, advertising platform policies, search engine algorithms, your pricing, and how inquiries are handled by your staff. While we work diligently on every account, we do not guarantee any specific results, including any particular number of leads, calls, cases, rankings, or revenue. Any figures shown on the Site, including dashboards and statistics, are illustrative examples unless expressly identified as actual client results.

3.Fees, Billing & Ad Spend

Management fees are billed as set out in your Service Agreement. Advertising spend (such as Google Ads budgets) is separate from our management fees and is billed directly to you by the advertising platform through your own accounts unless otherwise agreed in writing. You are responsible for all ad spend incurred in your accounts. Fees paid for completed service periods are non-refundable unless your Service Agreement states otherwise.

4.Client Accounts & Access

You retain ownership of your advertising accounts, business profiles, domains, and customer data. You agree to provide us the access reasonably necessary to perform the Services and to ensure that information you provide to us is accurate and lawful. You are responsible for compliance with laws and regulations applicable to your own business, including the FTC Funeral Rule and the funeral service laws and regulations of the state or states in which you operate.

5.Intellectual Property

The Site and its contents — including text, design, graphics, code, and branding — are owned by Sable Media or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute the Site's contents without our prior written consent. Deliverables created for clients (such as landing pages and ad copy) are governed by the applicable Service Agreement.

6.Acceptable Use

You agree not to use the Site to submit false or misleading information, interfere with the Site's operation, attempt to gain unauthorized access to any systems, or use any content from the Site for unlawful purposes.

7.Third-Party Platforms

The Services involve third-party platforms such as Google, Meta, and our CRM and hosting providers. We are not responsible for the acts, omissions, policies, or availability of third-party platforms, including account suspensions, policy changes, or outages.

8.Disclaimer of Warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SABLE MEDIA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR THE SERVICES. IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

10.Indemnification

You agree to indemnify and hold harmless Sable Media and its owners, employees, and contractors from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your violation of applicable law, or content and information you provide to us.

11.Termination

We may suspend or terminate access to the Site at any time for conduct that violates these Terms. Termination of client Services is governed by the applicable Service Agreement.

12.Governing Law & Disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles, regardless of where you are located or where Services are performed. Any dispute arising from these Terms or the Site will be resolved in the state or federal courts located in Salt Lake County, Utah, and you consent to personal jurisdiction and venue there.

13.Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

Privacy Policy

This Privacy Policy explains how Sable Media collects, uses, and protects information when you visit the Site or submit information to us. By using the Site, you agree to the practices described here.

Information you provide. When you submit a form on the Site (such as a quote request), we collect the information you enter — typically your name, email address, phone number, funeral home or business name, location or service area, and any notes or messages you include.

Information collected automatically. When you visit the Site, we and our service providers may automatically collect device and usage information such as IP address, browser type, pages viewed, referring URLs, approximate location, and interactions with the Site, using cookies, pixels, and similar technologies.

Advertising and analytics data. If you arrive at the Site through an advertisement, we may collect campaign identifiers (such as click IDs) used to measure advertising performance.

2.How We Use Information

We use the information we collect to respond to your inquiries and provide quotes; deliver, operate, and improve our Services and the Site; communicate with you by email, phone, or text message (where you have provided consent); measure and improve our marketing; maintain records and comply with legal obligations; and protect against fraud, abuse, and security threats.

3.Text Messaging Consent

If you provide your phone number and consent to receive text messages, we may send you messages related to your inquiry or our Services. Message frequency varies; message and data rates may apply. You can opt out at any time by replying STOP, or get assistance by replying HELP. We do not share mobile opt-in data or consent with third parties for their own marketing purposes.

4.How We Share Information

We do not sell your personal information. We share information only with: service providers that help us operate the Site and our business (such as our CRM, form, hosting, email, and call-tracking providers, including HighLevel, and advertising and analytics platforms such as Google); professional advisors where reasonably necessary; authorities when required by law, subpoena, or to protect rights and safety; and a successor entity in connection with a merger, acquisition, or sale of assets, in which case this Policy will continue to apply to previously collected information.

5.Cookies & Tracking

The Site uses cookies and similar technologies for functionality, analytics, and advertising measurement (for example, Google Analytics and Google Ads conversion tracking). 6.Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce agreements. Inquiry records are typically retained while we maintain a business relationship or a reasonable prospect of one, after which they are deleted or anonymized.

7.Security

We use commercially reasonable administrative and technical safeguards to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8.Your Privacy Rights

Depending on the state where you live, you may have rights regarding your personal information, including the right to access, correct, or delete the personal information we hold about you, and the right to opt out of certain processing. A growing number of states have comprehensive consumer privacy laws — including California (CCPA/CPRA), Colorado, Connecticut, Texas, Utah, Virginia, and others — and residents of those states may exercise the rights those laws provide. Marketing emails we send include an unsubscribe link. Opting out of marketing email does not affect transactional or service-related communications, such as responses to your direct inquiries.

10.Children's Privacy

The Site is intended for business audiences and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.

11.Third-Party Links

The Site may link to third-party websites or services. Their privacy practices are governed by their own policies, and we are not responsible for them.
